Cincinnati Area OSHA Office To Increase Crane-Related Inspections

The past weeks has seen an unusual amount of crane-related accidents in the national spotlight. These come on the heels of a similar accident in Cincinnati.  Submitted by Chris Dutton.
New Tennessee Immigration Law

On January 1, 2008, Tennessee House Bill No. 729 took effect, creating a revised Tennessee Code Annotated Section 50-1-103. Under the new state law, the Commissioner of Labor and Workforce Development may suspend the business license of any employer found to “knowingly employ, recruit, or refer for a fee for employment, an illegal alien.”  Submitted by Sarah Clark.
Attorney General's Opinion on Force Account Estimating Procedures

Attorney General Marc Dann issued an opinion on March 5, 2008 that clarifies a number of issues relating to force account work performed by public entities in the State of Ohio. The primary issues addressed are how the costs of materials and equipment acquired under a contract and the costs of work performed by subcontractors are to be addressed when preparing project estimates.  Submitted by John Higgins.
Two Versions of Design-Build Performance Bond Endorsed by Construction Trade Groups

In a collaborative effort of entities involved in the construction industry, a series of documents and forms have been endorsed for use on construction projects.  These documents and forms were issued in November 2007 and are called the ConsensusDOCS.  Submitted by David Olson.
Selection of Surety Bond Impacts Claims Process

Surety bonds are used on construction projects, both public and private.  The American Institute of Architects (AIA) approved a bond form in 1994 which is called the A312 form.  Under that bond form, the surety must respond to a claimant within 45 days after receipt of a claim noting the amount of the claim that is undisputed and state the basis for any challenges to the claim.
