| Indiana Supreme Court Issues Contentious Ruling On Leasehold Interest |

The Indiana Supreme Court, on October 15, 2009, issued a ruling that contains a strongly-worded concurrence by Chief Justice Shepard. Myers v. Leedy, 915 N.E.2d 133 (Ind. 2009). The case involved a contract sale of 200 acres in rural Indiana and concerned the interest of a tenant farmer. The majority opinion, written by Justice Rucker, frames the matter of first impression issue as whether a tenant’s leasehold property interest is extinguished by a land contract forfeiture when the tenant is not a party to the forfeiture and the land contract vendor has actual knowledge of the tenant’s possession of the property.
